Welcome to CAM4. These Terms and Conditions ("Terms", "Agreement") represent a legally binding contract between you ("User", "Broadcaster", "Viewer") and CAM4 ("we", "us", "our", "the Platform"). This Agreement governs your access to and use of the CAM4 website, its associated mobile applications, APIs, and all related services, content, and functionalities (collectively referred to as the "Services").
By registering an account, accessing the site, viewing streams, or utilizing any portion of the Services, you acknowledge that you have read, completely understood, and unequivocally agree to be bound by these Terms. If you do not accept these Terms in their entirety, you are expressly prohibited from using the Services and must immediately cease access. We strongly advise you to print or save a copy of this document for your records.
1. Eligibility and Strict Age Requirement
The core premise of CAM4 is an adult-oriented live streaming and dating environment. Consequently, strict eligibility criteria are enforced:
- Minimum Age: You must be at least eighteen (18) years of age, or the age of legal majority in your specific jurisdiction of residence, whichever is greater, to access or use the Services. Access by any individual under the age of 18 is strictly prohibited and constitutes a material breach of these Terms.
- Age Verification: We reserve the right to demand formal age verification from any user or broadcaster at any time. Failure to provide satisfactory government-issued identification proving your age will result in immediate and permanent account termination. Broadcasters are subject to rigorous identity and age verification protocols prior to initiating any live stream.
- Legal Compliance: You are solely responsible for ensuring that your use of the Services complies with all applicable local, state, national, and international laws and regulations in your jurisdiction. If your jurisdiction prohibits the viewing or distribution of adult content, you may not use CAM4.
2. Account Registration and Security
To fully interact with the platform, including participating in chats or tipping broadcasters, you must create an account. You agree to the following conditions regarding your account:
- Accurate Information: You agree to provide accurate, current, and complete information during the registration process and to continually update such information to keep it accurate. Providing false identity information is grounds for account suspension.
- Account Confidentiality: You are exclusively responsible for maintaining the confidentiality of your login credentials (username and password). You agree not to disclose your password to any third party. You are fully responsible for all activities, actions, and purchases that occur under your account, regardless of whether you authorized such activities.
- Notification of Breach: You must immediately notify CAM4 customer support if you suspect or become aware of any unauthorized use of your account or any other breach of security. We cannot and will not be liable for any loss or damage arising from your failure to protect your login credentials.
- Single Account Policy: Broadcasters are generally permitted to maintain only one active account. Viewers may maintain multiple accounts, provided they are not used for circumvention of bans, harassment, or abusive behaviors.
3. The CAM4 Token Economy and Virtual Currency
CAM4 utilizes a proprietary virtual currency system, known as "Tokens," to facilitate interactions between users and broadcasters. The following rules govern the Token economy:
- Purchasing Tokens: Tokens may be purchased using approved payment methods (e.g., credit cards, crypto, regional gateways). You represent that you are authorized to use the designated payment method. All token purchases are final and non-refundable, except where required by applicable law.
- Nature of Tokens: Tokens are a limited, non-transferable, revocable license to use certain features of the Services (e.g., tipping, private shows). They do not constitute real-world currency, property, or legal tender. Tokens have no monetary value outside of the CAM4 platform and cannot be redeemed for fiat currency by regular viewing users.
- Tipping and Transactions: When you transfer Tokens to a broadcaster (e.g., a "tip" or payment for a private show), that transaction is final. We do not mediate disputes over tips given voluntarily. Broadcasters define their own "tip menus" and pricing for private shows.
- Chargebacks and Fraud: Any attempt to fraudulently purchase tokens or initiate a chargeback without valid cause will result in immediate account termination. We reserve the right to dispute illegitimate chargebacks and recover funds through legal channels, and your account will be permanently banned from the network.
4. Broadcaster specific Terms and Compensation
Individuals who stream live content ("Broadcasters" or "Models") are subject to additional, specific terms governing their conduct and compensation:
- Independent Contractor Status: Broadcasters are strictly independent contractors. Nothing in these Terms creates an employer-employee, partnership, or agency relationship between CAM4 and any Broadcaster. Broadcasters are entirely responsible for their own tax obligations, equipment, and scheduling.
- Content Ownership: As a Broadcaster, you retain ownership of the copyright in your live streams. However, by broadcasting on CAM4, you grant us a worldwide, non-exclusive, royalty-free license to transmit, display, and promote your streams across our network.
- Compensation and Payouts: Broadcasters accumulate earnings based on Tokens received from viewers. Payout rates, conversion metrics, and payment schedules are detailed in the Broadcaster Dashboard. CAM4 reserves the right to modify payout structures with reasonable notice. We may withhold payments if we suspect fraudulent token acquisition or a violation of these Terms.
- Strict Compliance with 18 U.S.C. § 2257: All Broadcasters, and any individuals appearing on camera with them, must comply fully with United States federal record-keeping laws (18 U.S.C. § 2257). Broadcasters must submit valid government ID and consent forms for every person appearing in a stream before broadcasting begins.
5. Acceptable Use Policy and Prohibited Conduct
CAM4 maintains a strict community standard. We foster an environment of consensual adult entertainment. You agree not to engage in any of the following prohibited behaviors:
- Illegal Content: Uploading, streaming, or discussing any content that is illegal under applicable law. This includes, unequivocally, child sexual abuse material (CSAM), non-consensual imagery ("revenge porn"), bestiality, or the promotion of terrorism. Violations will be reported to relevant law enforcement agencies immediately.
- Violence and Self-Harm: Displaying or promoting acts of extreme violence, gore, or self-harm (e.g., cutting, suicide threats). The platform is for entertainment, not the display of real-world trauma.
- Harassment and Abuse: Engaging in targeted harassment, bullying, stalking, doxxing, or the use of hate speech against any broadcaster or fellow user. Respect the boundaries set by broadcasters in their rooms.
- Spam and Commercial Solicitation: Using the chat features or private messages to send unsolicited advertisements, spam, or links to external, competing platforms.
- Technical Interference: Attempting to reverse engineer, decompile, hack, or disrupt the operation of the CAM4 servers. The use of automated bots to scrape data, artificially inflate viewer counts, or spam chats is strictly forbidden.
- Underage Presence: At no time may anyone under the age of 18 appear on camera, even inadvertently or in the background. The presence of minors is an absolute zero-tolerance offense resulting in an instant, permanent ban.
6. Intellectual Property Rights
The CAM4 platform, including its original code, design elements, logos, graphics, and underlying architecture, is the exclusive property of CAM4 and its licensors, protected by international copyright and trademark laws.
You may not copy, reproduce, distribute, or create derivative works from the CAM4 interface without explicit written permission. Furthermore, users are strictly prohibited from recording, screen-capturing, downloading, or redistributing the live streams or private shows of Broadcasters without their explicit, documented consent. Unauthorized distribution of a Broadcaster's content is a violation of their copyright and our terms, and will result in a ban and potential legal action.
7. Digital Millennium Copyright Act (DMCA) Policy
CAM4 respects the intellectual property rights of others. If you believe that your copyrighted work has been infringed upon by content hosted on our platform, you must submit a formal DMCA takedown notice to our designated Copyright Agent. The notice must include:
- A physical or electronic signature of the copyright owner or their authorized agent.
- Identification of the copyrighted work claimed to have been infringed.
- Identification of the material that is claimed to be infringing, including a specific URL or sufficient detail to locate it on our platform.
- Your contact information (address, telephone number, email).
- A statement that you have a good faith belief that use of the material is not authorized by the copyright owner.
- A statement, made under penalty of perjury, that the information in the notification is accurate.
Submit DMCA notices to: [email protected]. We have a policy of terminating the accounts of repeat infringers.
8. Disclaimers and Limitations of Liability
Disclaimer of Warranties: The CAM4 Services are provided on an "AS IS" and "AS AVAILABLE" basis. We expressly disclaim all warranties of any kind, whether express or implied, including but not limited to the implied warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not guarantee that the platform will be uninterrupted, error-free, or entirely secure from malicious attacks. We do not endorse or guarantee the accuracy of any user-generated content or claims made by Broadcasters.
Limitation of Liability: To the maximum extent permitted by applicable law, in no event shall CAM4, its parent company, affiliates, directors, or employees be liable for any indirect, incidental, special, consequential, or punitive damages, including loss of profits, data, or goodwill, arising out of or in connection with your access to or use of the Services. In no event shall our total aggregate liability for any claims exceed the amount you paid to CAM4 in the six (6) months preceding the claim.
9. Indemnification
You agree to fiercely defend, indemnify, and hold harmless CAM4, its affiliates, and their respective officers, directors, and employees from and against any and all claims, damages, obligations, losses, liabilities, costs, or debt, and expenses (including attorney's fees) arising from: (i) your use of and access to the Services; (ii) your violation of any term of these Terms and Conditions; (iii) your violation of any third-party right, including without limitation any copyright, property, or privacy right; or (iv) any claim that your user-generated content caused damage to a third party.
10. Modification of Terms and Termination
We reserve the right, at our sole discretion, to modify or replace these Terms at any time. If a revision is material, we will provide at least 30 days' notice prior to any new terms taking effect, usually via a prominent notice on the site or an email. By continuing to access or use our Services after those revisions become effective, you agree to be bound by the revised terms.
We may terminate or suspend your account and bar access to the Services immediately, without prior notice or liability, under our sole discretion, for any reason whatsoever and without limitation, including but not limited to a breach of the Terms. If you wish to terminate your account, you may simply discontinue using the Services or request deletion via your account settings.
11. Governing Law and Dispute Resolution
These Terms shall be governed and construed in accordance with the laws of the jurisdiction in which CAM4's primary operating entity is incorporated, without regard to its conflict of law provisions. Any dispute arising from or relating to the subject matter of these Terms shall be finally settled by binding arbitration in that jurisdiction, except that either party may seek equitable relief in a court of competent jurisdiction to prevent intellectual property infringement.
